The bill requires exporters to report to the U.S. Bureau of Industry and Safety (BIS) if they find that the chip is being transferred, used or tampered with. This means that if, for example, Nvidia's accelerator appears in China after being sold to Singapore, or tracking technology is turned off, Nvidia must report it immediately.
The National Congressmen supporting the bill, including Bill Huizenga of Michigan and Bill Foster of Illinois, emphasize that this measure is important in preventing high-level GPUs from flowing into China through smuggling networks. "With advanced AI chips being smuggled into China, this threatens the national security structure and the country must take action," Foster said.
Although the bill does not clearly state the way of tracking mechanisms to operate, the minister of commerce must require relevant AI chips to have position verification capabilities within six months after the bill comes into effect. Long-term safety regulations will be evaluated over the next year.
The proposal of this bill comes as the Trump administration canceled Biden's expansion rules, which were intended to limit the export of high-level chips. Baigong has promised to introduce new control measures, but details remain unclear.
